By accessing or using Tivara, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App.

2. Eligibility

Tivara is intended for users who are 18 years of age or older. By using the App, you represent and warrant that:

3. Description of Service

Tivara is a location-based mobile application that enables users to:

• Explore interactive maps to discover AI characters
• Engage in conversations with AI companions through text and voice
• Use radar scanning features to locate nearby AI characters
• Track interactions and build relationships with AI characters
• Maintain personal profiles and journey records

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. User Accounts and Responsibilities

4.1 Account Creation

You may be required to create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account information.

4.2 User Content

You are solely responsible for any content you create, upload, or share through the App, including:

• Profile information and avatars
• Messages sent to AI characters
• Any other user-generated content

4.3 Prohibited Activities

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users or attempt to do so
• Transmit any malicious code, viruses, or harmful content
• Attempt to reverse engineer, decompile, or disassemble the App

5. Location Services

Tivara requires access to your device's location services to provide core functionality. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. You can control location permissions through your device settings, but some features may not function without location access.

6. AI Character Interactions

Tivara provides AI-powered characters for entertainment and interaction purposes. You understand and agree that:

• AI characters are computer-generated and do not represent real individuals
• Conversations with AI characters are for entertainment purposes
• AI responses are generated by third-party services and may not always be accurate or appropriate
• You should not rely on AI character advice for important decisions
• We are not responsible for the content generated by AI characters

7. Intellectual Property

7.1 Our Rights

The App, including its design, features, content, and functionality, is owned by Tivara and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

7.2 Your Rights

You retain ownership of any content you create or upload through the App. By using the App, you grant us a license to use, store, and process your content as necessary to provide the Service.

8. Third-Party Services

Tivara may integrate with third-party services, including:

• AI chat services for character conversations
• Map services for location features
• Other services necessary for app functionality

Your use of third-party services is subject to their respective terms and conditions. We are not responsible for the practices of third-party services.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

We strive to provide a reliable service, but we do not guarantee that the App will be available at all times or free from errors, interruptions, or defects. The Service is provided "as is" and "as available" without warranties of any kind.

9.2 Limitation of Liability

To the maximum extent permitted by law, Tivara and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the App.

9.3 Location-Based Risks

You acknowledge that using location-based features involves inherent risks. You are solely responsible for your safety and the safety of others when using the App in real-world locations.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tivara and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App, violation of these Terms, or infringement of any rights of another party.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including if you violate these Terms. Upon termination, your right to use the App will immediately cease.

You may stop using the App at any time by uninstalling it from your device.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tivara operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
